Land Drainage Consent

If you're planning any works that may affect watercourses in the North Kent Marshes Water Level Management Board (NKMWLMB) District, it’s essential to obtain Land Drainage Consent. This is a legal requirement under the Land Drainage Act 1991 and applies whether or not you have planning permission.

What is Land Drainage Consent?

Land Drainage Consent is required to ensure that any works near or affecting watercourses – such as culverting, installing structures, or modifying water flows – are properly assessed and managed so they do not increase flood risk, impede drainage, or harm the environment.

When is Consent needed?

You will need Land Drainage Consent if you are:

  • Installing or altering any structure that affects the flow of water (e.g., culverts, weirs, or dams).
  • Carrying out work within 9 metres of the edge of a watercourse.
  • Diverting or damming a watercourse.
  • Increasing the flow or volume of water into a watercourse.

How to apply for Land Drainage Consent

Applying for Land Drainage Consent is straightforward. Here’s how:

  3. Review process: Our team will review your application to ensure it meets the necessary safety and environmental standards.
  4. Decision: You will receive a decision within 2 months of full submission. If additional information is needed, we will contact you.

Fees and charges

A fee applies for each application for Land Drainage Consent. This fee covers the administrative costs of reviewing your proposal and ensuring compliance with legal and environmental standards.
